Terms of Use
These Terms of Use (“Terms”) govern your use of the website at teononqm.com (the “Website”) and of the TEO Non-QM application (the “Service”), provided by TEO NON-QM (“TEO,” “we,” “us”). By using the Website or the Service you agree to these Terms. If you use the Service on behalf of a company, you confirm that you have authority to bind it.
1. What TEO is, and what it is not
TEO is a software tool that helps licensed mortgage professionals, such as loan officers, mortgage brokers and real estate agents, search Non-QM lender guidelines and see which programs and products appear to fit a borrower scenario, and why others do not.
- TEO is not a lender or mortgage broker. It does not make loans, take applications, make credit decisions or offer, quote or guarantee any loan terms.
- Results are informational. They are based on lender guidelines as published and loaded into TEO. Guidelines change, may be incomplete, and may contain errors or delays in our reading of them.
- Always confirm eligibility, terms and pricing with the lender, using the lender’s own documents, before you rely on a result or advise a client.
2. Accounts, plans and users
- Individual: one user, 12-month agreement.
- Agency: two to ten users, 12-month agreement.
- On-Demand: one user for one month, a one-time payment, one-month agreement that does not renew automatically.
Each seat is for one named person. You may not share credentials or let others use your seat. You are responsible for the activity under your account and for keeping your credentials secure, and you must tell us promptly of any unauthorized use. Fees are as shown to you when you purchase and are payable in U.S. dollars, plus any applicable taxes. Fees are non-refundable except where the law requires otherwise or where we state otherwise in writing.
3. License and acceptable use
While your plan is active we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own internal business purposes. You agree not to:
- resell, sublicense or provide the Service to third parties, or use it to build a competing product or database;
- systematically extract, scrape, copy or bulk-export the catalog of lenders, programs, products or guideline data;
- reverse engineer, probe, disrupt or attempt to bypass the security or limits of the Service;
- use the Service in violation of any law, or to discriminate against any person on a basis prohibited by law;
- upload malicious code or content you have no right to use.
4. Your data and your responsibilities
You are responsible for the scenario and customer information you enter. You confirm that you have the right and any required consent to use it, and that your use of the Service and of borrower information complies with the laws that apply to you, which may include federal and state lending, licensing, privacy, consumer-protection and fair-lending laws. Please do not enter Social Security numbers, government ID numbers or bank account numbers. We handle personal information as described in our Privacy Policy.
5. Our intellectual property
The Service, the Website and everything in them, including software, design, text, the way guideline data is organized and the TEO name and logo, belong to TEO or its licensors and are protected by law. These Terms give you no ownership rights. If you send us feedback or suggestions, we may use them freely without obligation to you.
6. Third-party names, logos and documents
Lender names, logos and guideline documents belong to their respective owners and are shown only to identify the lenders whose guidelines are loaded in TEO. TEO is not affiliated with, sponsored or endorsed by any lender, and no lender endorses TEO.
7. Availability and changes
We work to keep the Service available and accurate, but we do not promise uninterrupted or error-free operation. We may update, add or remove features, lenders, programs and data, and we may suspend access for maintenance or security reasons.
8. Disclaimers
THE WEBSITE AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY RESULT IS CORRECT, CURRENT OR THAT ANY LENDER WILL APPROVE ANY LOAN.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TEO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST LOANS OR LOST BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE WEBSITE OR THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of this may not apply to you.
10. Indemnity
You will defend and indemnify TEO against claims, damages and costs (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms or of law, or the information you enter into the Service.
11. Term and termination
These Terms apply while you use the Website or the Service. We may suspend or end your access if you breach these Terms or if required by law. You may stop using the Service at any time, but fees already paid or owed for the current agreement term are not refunded except as stated in section 2. Sections that by their nature should survive termination will survive.
12. Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they were last changed. If you keep using the Website or the Service after an update, you accept the new Terms. For material changes that affect an active agreement term, we will give you reasonable notice.
13. General
These Terms, together with the Privacy Policy and any order you place with us, are the entire agreement between you and TEO about the Website and the Service. If a provision is found unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Our failure to enforce a provision is not a waiver of it.
